Nintendo and Microsoft have attained the upper hand in a “Personalized Instructional Aid” filed by an Australian inventor, Richard Baker, who claimed that the two companies have violated his patent. The patent covers technology that allows a computer to produce a personalized teaching presentation, which Baker claims to also cover virtual instructional aid in fitness video games.

However, Federal Circuit begged to differ. Siding with a previous ruling by a Washington federal judge, the Federal Circuit ruled in favour of Nintendo and Microsoft rather than Baker.
