Nintendo has filed a lawsuit against a content creator who streamed their games before launch.
The lawsuit is against content creator going by EveryGameGuru, who would frequently stream emulated and pirated games before their official release. Although Nintendo took action to take down his channel, EveryGameGuru taunted the company over emails, claiming that he had “thousands of burner channels” and that “he could do this all day”. He also vowed to “actively help people find newer and updated copies” of Switch emulators like Ryujinx and Yuzu, with the express purpose of helping people play Switch games on their PC without buying Nintendo’s hardware.
“On at least fifty occasions in the last two years, Defendant has streamed gameplay footage of pirated copies of at least ten different Nintendo games without authorization—all before those titles were released to the public, all of these streams were unauthorized and all compromise Nintendo’s legitimate prerelease marketing. They also promote and encourage downloading of pirated copies of unpublished games. Defendant’s streams often consist merely of him playing Nintendo’s leaked games without commentary for extended periods of time.”
Nintendo is seeking damages of $150,000 per infringement of its copyright. By the conservative estimate of “at least fifty occasions” stated in the excerpt above, EveryGameGuru is looking at to owe at least $7.5 million if Nintendo’s lawsuit is successful. Stay tuned for more updates as they come.
