Back in November 2024, Nintendo sought to sue content creator EveryGameGuru for streaming pirated games before their official release, but ran into trouble as they were unable to serve him his legal papers.

In the latest update to the case, Nintendo is now seeking a default judgment from the court, as EveryGameGuru has refused to respond to the lawsuit appropriately. The company seeks $17,500 in damages as well as a permanent injunction against the content creator, ordering him to cease further illegal actions and destroy “all circumvention devices” that may be in his possession.

The damage amount includes $10,000 for streaming Paper Mario: The Thousand-Year Door, which was chosen as “a representative work” out of the 10 Switch games EveryGameGuru streamed before their release, which is to “simplify the damages analysis”. The remaining $7,500 is from the use and trafficking of said “circumvention devices” to play pirated games, consisting of 15 violations fined at $500 each.
