Nintendo Wins Lawsuit Against Streamer Who Pirated Games

Nintendo has won its lawsuit against content creator EveryGameGuru, who was accused of streaming pirated games before launch.

As reported by Torrent Freak, Nintendo was awarded victory in the lawsuit by the Colorado court, with the creator required to pay Nintendo $17,500 in damages and be prohibited from piriting and infringing Nintendo’s property again in the future, including via streaming and by promoting access to Switch emulators.

However, the court rejected an additional request from Nintendo that EveryGameGuru “destroy all circumvention devices” in his possession, citing that it was too broad and “unreasonable”. They also denied Nintendo’s request that an injunction be issued against “third parties” involved in EveryGameGuru’s acts, as Nintendo did not specify which “third parties” they wanted served.

EveryGameGuru’s case became infamous partially due to his response to the lawsuit, which included taunting Nintendo’s legal team and evading their attempts to serve him the suit. Predictably this move did little to stall the inevitable outcome, handing Nintendo another victory in its battle against pirating their games.
