A few months back, Nintendo was targeted by a lawsuit in California, asserting that Nintendo needed to pass on any refunds they received after the US tariffs were ruled illegal by the Supreme Court.

According to an update from Gamefile, Nintendo has asked the courts to dismiss the lawsuit, saying that the consumers “received exactly what they bargained and paid for” when purchasing Nintendo products, and that they are “not entitled to a rebate” as a result of the US Supreme Court’s ruling.

“The common thread among Plaintiffs’ claims is that it is somehow ‘unfair; that Nintendo has not retroactively adjusted its prices for completed sales in response to the outcome of the tariff litigation. But that is now how commercial transactions work…”

Even back when news of the lawsuit first broke, analysts were skeptical that it would actually result in Nintendo refunding US consumers who potentially had to pay more for the Switch 2 as a result of the tariffs influencing the price. Stay tuned for more as it comes.
