Nintendo Facing Legal Action In Brazil Over Policy To Brick Switch 2 Systems That Violate User Agreement

A few months back, Nintendo updated their Nintendo Account Agreement with a clause stating that they have the right to render Switch consoles “permanently unusable” AKA “bricked”  if users violate the agreement. These violations include modding the console or using it to play pirated games.

According to a report from IGN, this policy has drawn attention from Procon-SP, the official body in charge of consumer protections in Brazil. Procon-SP believes that this clause violates the right of consumers to have access to services that they have legally paid for, and demands that Nintendo remove this clause from the agreement. This is of particular interest for Brazillian consumers, as Nintendo has no official presence in Brazil, meaning consumers would have great difficulty having their access restored if their console was bricked in error.

Following the introduction of this clause, there have been reports of Switch 2 consoles being bricked after using exploits. There have also been reports that once a console is bricked in this manner, it will remain that way forever, with one user saying that they had unknowingly purchased a second-hand Switch 2 which had previously been bricked.

Procon-SP has said they already contacted Nintendo Of America for a response, with a deadline set for July 15, 2025. Stay tuned for more updates as they come.
