Nintendo Settles Switch 2 Lawsuit With Accessory Maker Genki
Earlier this year, Nintendo filed a lawsuit against accessory maker Genki for marketing accessories for the Switch 2 before the console’s official reveal, allegedly violating Nintendo’s trademarks in the process.
According to new court documents (via Oatmealdome), Nintendo has reached a settlement with Genki over the suit. The documents state that Genki will pay Nintendo a confidential amount of in damages, and will no longer be allowed to use names and branding that is “confusingly similar” to Nintendo’s. This includes using color schemes similar to Nintendo’s branding, as well as labelling products using terms like “Glitch 2”, or calling their presentations things like “Genki Directs”.
In addition, its confirmed definitively that Genki did not obtain a pre-launch Switch 2 to develop their products, according to this segment of the court documents:
“Defendant (Genki) represents and attests that it did not obtain access to any of Plaintiff’s (Nintendo) property (e.g., including but not limited to an unreleased Switch 2 or any documents, files, consoles, or accessories relating thereto) prior to the Plaintiff’s First Look Trailer or official launch of the Switch 2.
“The parties have resolved Plaintiff’s claims in this action pursuant to a separate confidential settlement agreement (the “Agreement”) that operates in conjunction with this Final Judgment and Permanent Injunction (“Consent Judgment”).”
All in all, the result is a clear victory for Nintendo, who likely did not appreciate Genki going viral for showing off accessories for the Switch 2 before Nintendo was ready to reveal it.
