Sued Switch Hardware Modder Taking On Nintendo Without A Lawyer

A Switch modchip seller who is being sued by Nintendo is seemingly preparing to defend himself without a lawyer.

The seller in question is Ryan Daly, who runs a store called Modded Hardware which sold modded and MIG enabled Switch consoles. Nintendo reportedly contacted Daly back in March asking him to cease selling his modified Switch consoles. Nintendo later claimed that Daly had continued to sell his wares despite agreeing to their terms, and filed a lawsuit against him in July for  “trafficking in circumvention devices”, copyright infringement and more.

Now, Daly has filed a response to Nintendo’s claims denying any wrongdoing on his part. As detailed by TorrentFreak, Daly either denied Nintendo’s claims outright or stated he “didn’t have enough information to admit or deny them”, which constitutes a denial. Daly also filed 17 ‘affirmative defences’ that could exempt him from liability to the claims, including appeals to  fair use, invalid copyrights, unjust enrichment and fraudulent enducement.

Daly’s act of responding means the case will go into discovery, allowing both parties to gather evidence for the case and essentially kicking off the legal battle proper. What is interesting however is that Daly currently still does not have a lawyer, and will seemingly be representing himself in court against Nintendo’s infamously competent legal team. Only time will tell how this will pan out for him.
